Terms of Service

1. Acceptance of Terms

By accessing or using ineedartists.com ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

ineedartists.com is a marketplace that connects clients with verified artists for commissioned artwork. We provide the platform and tools for discovery, communication, payment processing, and dispute resolution.

3. User Accounts

3.1 Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials.

3.2 Account Types

Users may act as clients (commissioning art) and/or artists (fulfilling commissions). Artists must complete verification to accept commissions.

3.3 Age Requirement

You must be at least 13 years old to create an account or use the Platform. We ask for your date of birth before an account is created, and that date is verified automatically before you can sign up. Accounts registered by anyone under 13 are not permitted.

To register you must give an accurate date of birth and meet the minimum age. Accounts belonging to users under 13 are blocked from using the Platform and are deleted, together with the personal data associated with them. If you believe someone under 13 has created an account, please report it to support@ineedartists.com.

By creating an account you confirm that you meet the age requirement and that you accept these Terms of Service and our Privacy Policy. We record the date on which you accepted them. If you do not agree to these terms, do not create an account or use the Platform.

Users must be 18 years or older to view NSFW content, purchase a Verified+ subscription, or take part in paid transactions.

4. Artist Verification

4.1 Verification Tiers

Artists must complete our verification process, which includes providing proof-of-process documentation. We offer two verification tiers:

• Verified: Artists provide proof-of-process (timelapse, layered files, WIP progression)
• Verified+: Artists provide proof-of-process plus identity verification with monthly promotion credits

4.2 Subscription Benefits

Verified+ artists receive reduced platform fees (5% vs 10%) and monthly promotion credits to boost their packages in search results.

5. Commission Process

5.1 Requesting Commissions

Clients submit commission requests through artist profile pages. Artists may accept or decline requests at their discretion.

5.2 Payments

Payments are processed through Stripe. Funds are held securely until the commission is completed and approved by the client. Platform fees are deducted from the artist's payout:

• Verified artists: 10% platform fee
• Verified+ artists: 5% platform fee

Artists receive payouts through Stripe Connect to their connected bank account.

5.3 Delivery & Revisions

Artists must deliver work within the agreed timeframe. Revision limits are specified in each package. Additional revisions may be negotiated between parties.

5.4 Quotes & Custom Projects

For projects requiring custom quotes, clients may submit general enquiries. Artists can provide detailed quotes with pricing, milestones, and estimated delivery times.

6. Prohibited Content & Conduct

• Using generative AI to create commissioned artwork
• Submitting AI-generated work as human-made
• Infringing on copyrights or intellectual property
• Harassment, discrimination, or abusive behavior
• Fraud or misrepresentation
• Circumventing platform fees through off-platform transactions
• Uploading or sharing content that violates our content policies

6.1 NSFW Content

NSFW (Not Safe For Work) content is permitted but must be properly tagged. Users must be 18+ to view NSFW content and must confirm their age. Artists posting NSFW content must clearly mark their profiles and portfolio items.

7. Intellectual Property

7.1 Artwork Rights

Unless otherwise agreed, artists retain copyright to their work. Clients receive a license for the specified usage (personal or commercial as indicated). Artists may display commissioned work in their portfolios unless restricted by the commission terms.

7.2 Portfolio & Paid Content

Artists may offer portfolio items for purchase with pay-to-unlock full resolution access. Watermarked previews may be displayed publicly. Buyers receive personal use licenses unless commercial rights are explicitly granted.

7.3 Platform Content

All platform content, including logos, design, and code, is owned by ineedartists.com.

8. Disputes & Refunds

Disputes between clients and artists should first be resolved through direct communication via our messaging system. If unresolved, either party may file a formal dispute through their order dashboard. Our support team will review evidence from both parties and make a decision within 5-7 business days. We reserve the right to mediate disputes and issue full or partial refunds at our discretion based on work completed and commission progress.

9. Limitation of Liability

ineedartists.com is not liable for the quality, accuracy, or completion of commissioned work. We provide the platform but are not a party to the agreement between client and artist. Our liability is limited to the platform fees collected.

10. Termination

We may suspend or terminate accounts that violate these terms. Users may request account deletion at any time, subject to completion of outstanding obligations.

11. Changes to Terms

We may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.

12. Reporting & Moderation

Users can report profiles, content, or behavior that violates our policies. All reports are reviewed by our moderation team. We may suspend or permanently ban accounts that violate these terms.
